Former AMA Chairman Smilie Sentenced

Former American Motorcyclist Association (AMA) Board Chairman Dal Smilie was sentenced Monday, Feb. 22, to eight months in prison and two years probation for embezzling more than $100,000 through fraudulent travel reimbursement claims submitted to the AMA over a period of years ending in 2007.

Smilie pleaded guilty to felony counts of grand theft by deception and of receiving stolen property in the Fairfield County, Ohio, courtroom of Judge Chris Martin. He was taken directly into custody to begin serving a sentence that could see him request early release after 30 days.

Speaking to Judge Martin before his sentencing, Smilie expressed remorse for his actions.

"I've got much to apologize for, and many people to apologize to, including AMA members, AMA staff, my fellow board members and volunteers," he said. "I've let them down."

Smilie acknowledged that his fraudulent travel-reimbursement claims stemmed from his time as an AMA board member. "I overstated travel claims," he said. "I co-mingled funds. That's misappropriation. That's theft. That's a breach of trust, and I'm sorry for that. I was an honorable person, and I kind of slid into this. I don't have good excuses."

Fairfield County Assistant Prosecutor Gregg Marx said after the hearing that the sentence was appropriate, especially in light of the fact that Smilie paid restitution to the AMA for the money in question. "We're very pleased with the resolution of this case."

AMA President and CEO Rob Dingman echoed those sentiments. "On behalf of the members of the American Motorcyclist Association, we are satisfied that justice has been served, and we are glad to put this matter behind us," he said.

Who hasn't been letdown by leadership before? Our Congressmen and Senators, hell, even the Pres chasing around their own agenda, leaving us common folk to fend the best we can. The AMA is a resource, just like other resources, but as motorcyclists, we don't have many organizations coherently representing us and our freedoms in the political arena. We still need the AMA, but we need to acknowledge that no organization is exempt from the deeds of self-serving individuals. We just need to try to ferret them out and lock them up whenever we can. The plea deal got the organization their money back, and exposed a thief for who he was. Let's get back to the interests of riders, all riders.

I understand what you’re saying Joe. I guess I’m just venting a little, Big Business, Big Government, and the little people flipping the bill. I use to be in the idealistic” we all can make a change group”, but the older I get, the more it seems like the “take advantage only in it for myself group” is winning. Maybe I have the winter blues…

Guy, there has been change. The reason Smilie was brought to justice is the new leadership uncovered the crime and did what is right. It is a new AMA. I know what you'll say: "I'll believe it when I see it." Well, if seeing the former chairman go to prison isn't "seeing it," nothing is. What I'm seeing is the new boss sending a pretty firm message: Don't play games with my member's money.

After a long look at what I think the AMA has become, this is the final nail in the coffin. I was actually pondering not renewing after over twenty years of membership. But now I will not. I’ve come to think of the AMA directors and staff as people living off of our finances to better themselves, not motorcycling. They talk the talk, tell us to get involved, and I do… But see no benefit to myself and the sport I love. They keep blabbing about grass-roots movements, but then what do we need them for? Live like rock stars, gloss n’ glitz, and pat themselves on the back with our money. Now I know someone will say there is nothing better out there, but maybe it’s time for a change. Just my 2c.

How exactly does an eight month stretch leave you open to apply for early release after 30 days? Whatever happened to truth in sentencing and the punishment fitting the crime...
