It’s no secret that the OHV community is fed up over the CPSC lead ban, which outlaws ATV and motorcycles marketed to children under the age of 12. Outraged riders have flooded legislative representatives with pleas to overturn the rule, but Malcolm Smith is taking it one step further – the off-road riding legend is openly defying the lead ban by selling outlawed models at his California dealership.

The
Kids Love 2 Ride Protest will take place 4 p.m. on March 19, 2009 at the Malcolm Smith Motorsports in Riverside, California. Facing the consequence of potential fines, Smith plans to sell banned models to well-known industry personalities like racers Jeff Ward and Jeremy McGrath.

In defiance of the Consumer Product Safety Improvement Act of 2008 which prohibits the sale of youth motorcycles and ATVs deemed unhealthy for children under 12 due to suspected high-levels of lead content, motorcycle dealer Malcolm Smith will sell these banned vehicles as a sign of protest. As a sign of support, a group of small business people and high-profile motorcycle industry celebrities, including racers Jeff Ward and Jeremy McGrath, Glen Helen Raceway owner Bud Feldkamp, and motorsport design guru Troy Lee have all agreed to be on hand to purchase banned units for use by their own children and grandchildren.

Passed by overwhelming bi-partisan support in the House and Senate, the Consumer Product Safety Improvement Act of 2008 intended to block the dangerous entry and sales of lead-based products, most notably children’s toys from China. The Consumer Product Safety Commission, however, has narrowly interpreted the law to any products marketed to children under 12 – including children’s OHVs. Efforts are being led by OHV groups and the AMA to reverse the ruling, either with new legislation or changes at the CPSC.
Hopefully Smith’s act of civil disobedience will jumpstart a stagnant process that is bleeding millions of dollars from the motorcycle industry.
